Florida HB 3 rules for social media apps with teenage users
HB 3 (ch. 2024-42, Fla. Stat. s. 501.1736) took effect January 1, 2025. It covers a social media app or site only when four tests are met: users can post or view others' content, at least 10 percent of daily users under 16 average 2 or more hours a day, algorithms select content, and the service has an addictive feature such as infinite scroll or push notifications. A covered platform must bar users under 14, require parental consent for 14- and 15-year-olds and terminate accounts that do not comply. The Attorney General can seek up to $50,000 per violation, and minors can recover damages of up to $10,000. In June 2025 a district court preliminarily enjoined the under-14 ban and the parental-consent rule, but on November 25, 2025 an Eleventh Circuit panel stayed that injunction pending appeal, so Florida may enforce both while the appeal proceeds. With a ranked feed and push notifications, test the usage thresholds early.
