Colorado sales tax on SaaS: the rule now and from January 2027
Department of Revenue guidance revised in February 2021 says state-administered sales tax applies to software only when it is prepackaged, under a tear-open nonnegotiable license and delivered on a physical medium, so hosted SaaS and electronic downloads are not taxable. That guidance reflects the law until HB26-1223's software changes apply, and it does not apply to home-rule cities. HB26-1223, signed June 4, 2026, makes computer software taxable for sales on or after January 1, 2027, defining it as code delivered by any means, including download or remote access through the internet, and including phone and tablet apps. Only software developed for a particular user, or governed by an individually negotiated license signed by both parties, stays exempt. Click-through, browse-wrap, account-creation and website-terms acceptance do not qualify. Local governments whose taxes the state collects take on the change only through a local election. The state rate is 2.9%.
