SaaS Development for Monaco: VAT, SEPA and EU Customers

Selling a subscription to consumers in Monaco usually brings Monaco VAT into play, at a standard rate of 20%, because the Principality's VAT code treats electronically supplied services, software included, as supplied there when the buyer is a non-taxable person established or habitually resident in Monaco. Add a withdrawal right of seven clear days, plus EU business customers who cannot rely on an adequacy decision when they send data to a vendor based there, and most of the hard parts sit outside the interface.

Curiosive is a studio working from Ankara, Türkiye, that builds with AI coding agents and has senior engineers review every change. Engineers design the multi-tenant data model, tenant isolation, plan and entitlement logic and idempotent billing webhooks. Agents produce the CRUD screens, admin views, migrations and the test suites around them. Local clocks trail Ankara's by no more than two hours in any season, so billing questions and code reviews fit inside a shared working day.

Monaco VAT on SaaS Subscriptions Sold to Consumers

The Code des taxes sur le chiffre d'affaires sets the standard VAT rate at 20% (Article 51). Under Article 14 bis, read with Article 13-12° and annex Article A-187 C, electronically supplied services such as the supply and updating of software, website hosting and remote maintenance of programs count as supplied in the Principality when the customer is a non-taxable person established or habitually resident there. The exception is narrow: suppliers established in a single EU member state other than France, whose cross-border consumer sales stay under EUR 10,000 a year and who have not opted for taxation in the customer's location. For product design this means checkout must know whether a buyer is a consumer or a business and where they live, and invoices must show the tax correctly. We build that as tested logic rather than a settings toggle, and your accountant should confirm the position for your entity.

Billing Monaco Customers in Euros Over SEPA

The European Central Bank lists Monaco, as a non-EU country, among the 41 European countries of the SEPA region, so euro SEPA credit transfers and direct debits are available for billing customers there. That suits a product priced in euros, since the euro is the official currency there even though the Principality sits outside the euro area. The harder engineering is keeping subscription state honest. Billing events from the payment provider are the single record of what a customer has paid for, and handlers are written so that an event delivered a second time changes nothing. Each lifecycle path, from trial to upgrade, downgrade, failed payment and cancellation, gets its own test, and a senior engineer reviews every payment path. We have built this before: subscription billing for PicKey (pickey.ai), a visual password manager for a client in India, and per-title entitlement for Inspire Film (inspire.film), a virtual cinema for a client in Spain.

Seven-Day Withdrawal Rights Under Monaco's Digital Principality Law

Law No. 1.383 of 2 August 2011 for a Digital Principality applies to electronic distance sales whenever the customer is established in the Principality, and gives the Principality's courts jurisdiction over disputes with consumers there (Article 4). Under Article 10, consumers have seven clear days (jours francs) to withdraw, and for services the clock starts on acceptance of the offer. If the mandatory pre-contract information was not given, the period extends to three months. Refunds are due within 30 days. For a consumer SaaS this is product work: the signup flow must show the required information before the contract forms, the subscription record must store when the offer was accepted, and the cancellation path must issue the refund and revoke entitlements together. Agents generate the screens and tests, while engineers own the state changes.

EU Data Transfers and Monaco Representatives for SaaS Vendors

The Principality does not appear on the European Commission's adequacy list as checked on 2 October 2026, so EU or EEA controllers sending personal data to a SaaS vendor established there cannot rely on adequacy. They need another tool such as the Standard Contractual Clauses in Commission Implementing Decision (EU) 2021/914 of 4 June 2021, whose Clause 14 has both parties warrant they have no reason to believe the destination's laws and practices prevent the importer from complying. Türkiye has no EU adequacy decision either, and EDPB Guidelines 05/2021 treat remote access from a third country as a transfer when the criteria are met, so EU personal data made available to us needs its own transfer tool. A vendor established outside Monaco faces the reverse question: Law No. 1.565 applies when it offers services to people there (Article 3), and Article 25 requires a written representative in Monaco or, failing that, in an EU member state, unless processing is occasional and involves no large-scale sensitive data.

Questions

The things people ask before starting.

Is VAT due on a SaaS subscription sold to consumers in Monaco?

Generally yes, at the 20% standard rate, when the buyer is a non-taxable person established or habitually resident there. The narrow exception covers suppliers established in a single EU member state other than France whose cross-border consumer sales stay under EUR 10,000 a year and who have not opted for taxation in the customer's location.

How long do consumers in Monaco have to withdraw from an online subscription?

Seven clear days (jours francs) under Article 10 of Law No. 1.383, counted from acceptance of the offer for services. If the mandatory pre-contract information was missing, the period stretches to three months, and refunds are due within 30 days. Storing the acceptance time on the subscription record shows which window applies.

How much does it cost to build a SaaS MVP for the Monaco market?

Work runs as AI-accelerated development, starting from $2,000 per month, with scope agreed in writing. Both are US dollar starting points rather than quotes, and VAT handling for local consumers, SEPA billing and the withdrawal flow are part of what discovery sizes.

Can EU companies send personal data to my SaaS business in Monaco?

Yes, but not on the basis of adequacy. The Principality had no EU adequacy decision as checked on 2 October 2026, so your EU customers need another transfer tool, such as Standard Contractual Clauses. Prepare the data processing terms, the list of sub-processors and tenant-level export early, so they are ready before the first contract.

How it starts

What happens after you write to us.

  1. 01

    You describe the product

One paragraph on what you are building, roughly when you need it, and who it is for. No brief, no form with fifteen fields.

  2. 02

You get a reply within a day

From the engineer who would do the work, not a sales team. If we are not the right fit we say so, and where possible we point you somewhere better.

  3. 03

    You get a scoped plan

Scope, price and timeline in writing before anything is committed. You decide with the numbers in front of you.

No long contract to begin, no lock-in to our tooling, and the code is yours from the first commit.

Looking for an engineering partner for the long haul?

A short note about the product, the timeline and who it is for is enough to start. You will hear back from the engineer who would do the work, not a sales team.
