Malta's Data Protection Act and engineers working from Türkiye
The national statute is the Data Protection Act (Chapter 586 of the Laws of Malta, Act XX of 2018), which replaced Chapter 440, and the supervisory authority is the Office of the Information and Data Protection Commissioner (IDPC) at idpc.org.mt. As of 2 October 2026, Türkiye is not on the European Commission's list of adequacy decisions. EDPB Guidelines 05/2021 treat remote access from a third country as a transfer when the three transfer criteria are met, even if it only means displaying personal data on a screen for support or troubleshooting. So if our engineers help run a system holding your users' data, that access needs a Chapter V tool, such as Standard Contractual Clauses under Decision (EU) 2021/914. They come in four modules, so pick the one that matches each party's role, and note that under Clause 14 both sides warrant they have no reason to believe the destination's laws prevent compliance. Keep personal data out of development environments where you can, and sign before production access is granted.
